These Terms and Conditions (“Terms”) govern your use of historictownsofamerica.com, travel.historictownsofamerica.com, and any related pages, newsletters, and digital products operated by Historic Towns of America (“HTOA,” “we,” “us,” or “our”) (together, the “Site”).
By using the Site or buying a product from us, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site. You must be at least 18 years old, or have a parent or guardian’s permission, to make a purchase.
1. Use of the Site and Our Content
All content on the Site is owned by HTOA or its licensors and protected by U.S. copyright and trademark law. That includes articles, photographs, videos, maps, itineraries, travel guides, logos, and the “Historic Towns of America” name.
You may: read, view, and share links to our pages, and print or save pages for your own personal, non-commercial use.
You may not, without our written permission:
- Copy, republish, sell, or redistribute our content, photos, or videos.
- Scrape, crawl, or bulk-download the Site, or use our content to train artificial intelligence or machine-learning models.
- Use our name or logo in a way that suggests we endorse you.
- Interfere with the Site’s security or operation, or use it for any unlawful purpose.
Short quotations with credit and a link back to the original page are welcome. For licensing or media requests, contact us (Section 9).
2. Travel Guide Purchases
Our travel guides are digital downloads, delivered immediately after payment. No physical item is shipped.
Pricing and payment. Prices are shown in U.S. dollars at checkout and may change at any time; changes do not affect orders already paid. Payments are processed by our third-party payment provider (such as PayPal or Stripe). We do not receive or store your full card number. Any applicable sales tax is added at checkout.
Delivery. After payment, you receive a download link on the confirmation page and by email. If you do not receive it within 24 hours, check your spam folder, then contact us and we will resend it.
Your license. Each purchase gives you a personal, non-transferable, non-exclusive license to download, print, and use the guide for your own travel planning. You may not resell, share, post online, upload to file-sharing sites, or otherwise distribute the guide, in whole or in part. All rights not granted are reserved by HTOA.
Refunds. Because guides are digital and delivered instantly, all sales are final. We will gladly issue a refund or replacement if, within 14 days of purchase:
- The file is damaged, will not open, or the download link does not work, and we cannot fix it.
- You were charged twice or bought the same guide by mistake.
- You did not receive the guide at all.
To request help, contact us with your order number. Approved refunds are returned to your original payment method. Please contact us before filing a chargeback so we can resolve the issue quickly.
3. Affiliate Links, Booking Partners, and Donations
Affiliate disclosure. HTOA earns money through affiliate marketing. Some links on the Site, including hotel, flight, tour, ticket, insurance, and product links, are affiliate links. If you click one and make a purchase or booking, we may earn a commission at no extra cost to you. We only recommend places and services we believe are useful to our readers, and commissions do not change our editorial opinions.
Bookings are with the partner, not HTOA. When you book through a partner link (such as Expedia, Trip.com, or other booking agencies), your contract is with that partner. The partner sets prices, availability, payment, cancellation, and refund rules. HTOA is not a travel agent, does not process those bookings, and is not responsible for the partner’s products, services, or errors. Please direct booking questions and refund requests to the partner.
Sponsored content. Content that we are paid to publish is clearly labeled as sponsored or a paid partnership.
Donations. Donations are voluntary, processed by PayPal, and non-refundable except in cases of error. HTOA is not a registered nonprofit, so donations are not tax-deductible.
4. Travel and Historical Information Disclaimer
We personally visit and research the places we feature, but travel details change. Hours, prices, admission rules, accessibility, road conditions, and whether a site is open can change without notice. Always confirm details directly with the destination before you travel.
Our historical content reflects careful research and the best available sources at the time of writing. Historians sometimes disagree, and new evidence can change what we know. If you spot an error, please tell us and we will review it.
You are responsible for your own travel decisions, safety, and conduct, including following local laws, posted rules, and property boundaries. Content on the Site is for general information only and is not professional travel, legal, financial, or insurance advice.
5. No Warranties
The Site, its content, and our travel guides are provided “as is” and “as available,” without warranties of any kind, express or implied. This includes warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Site will always be available or error-free.
6. Limitation of Liability
To the fullest extent permitted by law, HTOA and its owners, contributors, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, our content, our guides, or any third-party booking, product, or service. This includes lost trips, missed reservations, travel expenses, injury, or property damage.
Our total liability for any claim related to the Site or a purchase is limited to the amount you paid HTOA in the 12 months before the claim, or $50, whichever is greater. Some states do not allow certain limitations, so some of these may not apply to you.
7. Indemnification
You agree to defend and hold HTOA harmless from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, or your violation of anyone else’s rights.
8. Governing Law and Changes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Nassau County, New York, and you consent to their jurisdiction. Before filing any claim, you agree to contact us and try to resolve the dispute informally for at least 30 days.
We may update these Terms at any time by posting a new version and changing the “Last updated” date. Purchases are governed by the Terms in effect when you bought. If any part of these Terms is found unenforceable, the rest remains in effect.
